Terms of Service

Last updated: 16 September 2026

Welcome to Birth Bumps. These Terms of Service apply when you use our website or purchase products from us.

Please read them before placing an order. They explain who we are, how purchases are made, and the different provisions applying to consumers and professional customers.

Our Shipping Policy, Return and Refund Policy, and Privacy and Cookie Policy form part of these Terms.

1. About Birth Bumps

This website and online store are operated by:

Jenny Parsons trading as Birth Bumps
Tudor Cottage
Pilgrims Way
Westhumble
RH5 6AW
United Kingdom

Email: info@birthbumps.com

In these Terms, “Birth Bumps”, “we”, “us” and “our” refer to Jenny Parsons trading as Birth Bumps.

2. Who These Terms Apply To

These Terms apply to consumers and professional customers.

A consumer is an individual purchasing products mainly for personal use and not primarily for purposes relating to their trade, business, craft or profession.

A professional customer is a person or organisation purchasing products mainly for use in a business, professional service, class, clinic or educational setting, or for resale.

Some rights and responsibilities differ depending on which type of customer you are. Where a section applies only to consumers or professional customers, we make this clear.

If you purchase on behalf of an organisation, you confirm that you have authority to place the order and agree to these Terms on its behalf.

3. Age and Authority to Purchase

You must be at least 18 years old or otherwise legally capable of entering into a binding contract to place an order.

If you purchase on behalf of a business, clinic, school or other organisation, you confirm that you have authority to bind that organisation.

4. Using Our Website

You may use our website for lawful purposes and in accordance with these Terms.

You must not:

  • use the website for any unlawful or fraudulent purpose;

  • interfere with its operation or security;

  • introduce viruses, malware or other harmful material;

  • attempt to gain unauthorised access to the website or connected systems;

  • collect personal information about other users without permission;

  • impersonate another person or misrepresent your identity;

  • send unsolicited messages through the website;

  • scrape or systematically extract website content without permission; or

  • copy or commercially exploit website content except as expressly permitted.

We may suspend or restrict access where we reasonably believe the website is being misused. This will not affect rights relating to an order already accepted.

5. Customer Accounts

Customers may be able to create an optional account or purchase as a guest.

You are responsible for:

  • providing accurate and current information;

  • keeping access to your email and account secure; and

  • notifying us if you believe your account has been accessed without permission.

Birth Bumps uses Shopify’s new customer-account system, which may authenticate customers by sending a secure sign-in code to their email address.

We may suspend or close an account that is being used fraudulently, unlawfully or in serious breach of these Terms. Closing an account does not remove rights or obligations connected with an existing order.

6. Our Products

We take reasonable care to describe and display our products accurately. Colours and appearance may vary slightly depending on lighting, photography and the screen used to view the website.

Product packaging may change from time to time, provided this does not materially alter the product ordered.

Please read the product description before purchasing. If you have questions about a product or its suitability for your intended use, contact us before placing your order.

Nothing in these Terms limits a consumer’s right to receive products that match their description, are of satisfactory quality and are fit for any purpose made known to us.

7. The Purpose of Birth Bumps Products

Birth Bumps products are designed to support conversation, learning and birth preparation.

They provide general educational information and are not intended to provide individual medical advice, diagnosis or treatment, or to replace advice from a midwife, doctor or other appropriately qualified healthcare professional.

Birth is individual and may unfold in different ways. Birth Bumps does not promise or guarantee a particular birth experience or outcome.

Customers should seek appropriate professional advice about their individual circumstances and contact their maternity team if they have questions or concerns about their health, pregnancy or birth.

Professional customers remain responsible for their own professional judgement, services, teaching, advice, insurance and compliance with the professional standards and legal obligations applying to their work.

Purchasing or using a Birth Bumps product does not provide a professional qualification, certification or accreditation.

8. Placing an Order

When you place an order, you are offering to purchase the products in your basket subject to these Terms.

After placing an order, you should receive an acknowledgement by email. This confirms that we have received the order but does not necessarily mean it has been accepted.

A contract between you and Birth Bumps is formed when we confirm that your order has been accepted or dispatched.

Please check your order confirmation and contact us promptly if any information is incorrect.

9. When We May Decline or Cancel an Order

We may decline or cancel an order before dispatch if:

  • a product is unavailable;

  • payment has not been authorised;

  • there is an obvious error in the price or product description;

  • we cannot deliver to the address provided;

  • we reasonably suspect fraud, misuse or unlawful activity;

  • the order exceeds a stated quantity restriction; or

  • we cannot fulfil the order for another reasonable legal or commercial reason.

If we cancel an order after taking payment, we will refund the amount paid for the cancelled products and any associated delivery charge.

10. Prices and Payment

Prices are shown in pounds sterling and include any taxes we are required to charge, unless clearly stated otherwise.

Delivery charges are additional and will be shown before you complete your purchase.

You must provide complete and accurate payment and billing information.

Payments are processed through Shopify Payments or another payment method offered at checkout. Birth Bumps does not normally receive or store complete payment-card details.

We may change prices at any time, but a change will not affect an order we have already accepted.

If we discover an obvious pricing error, we may contact you to ask whether you wish to proceed at the correct price. If you do not wish to proceed, or we cannot contact you, we may cancel the order and refund any payment made.

11. Discounts and Promotions

Discount codes and promotions are subject to any conditions stated with the offer.

Unless stated otherwise:

  • only one discount code may be used per order;

  • codes cannot be exchanged for cash;

  • codes must be used before their expiry date;

  • codes cannot normally be applied retrospectively; and

  • discounts apply only to eligible products.

We may amend or withdraw a promotion before an order is placed. This will not affect an order we have already accepted.

Clinic Partner, referral and commission codes may be subject to separate partnership conditions.

12. Shipping and Delivery

Our preparation, dispatch and delivery arrangements are explained in our Shipping Policy, which forms part of these Terms.

For consumer orders, Birth Bumps remains responsible for the products until they are delivered to you or to a person you have nominated to receive them.

If you appoint a carrier that was not offered by us, responsibility may pass to you when the products are handed to that carrier.

Unless a different period has been agreed, consumer orders will be delivered without undue delay and no later than 30 days after the contract is formed.

13. Cancellations, Returns and Refunds

Consumer cancellation rights, returns, refunds, faulty products, exchanges, Gift Cards and professional goodwill returns are explained in our Return and Refund Policy, which forms part of these Terms.

Nothing in these Terms or our policies limits or replaces a consumer’s statutory rights.

14. Professional and Business Orders

An order placed mainly for use within a business, class, clinic, professional service or for resale is a professional or business purchase.

Consumer cancellation rights do not normally apply to these purchases. Birth Bumps nevertheless offers professional customers the goodwill return arrangements described in our Return and Refund Policy.

Professional customers are responsible for determining whether a product is suitable for their business, clients, teaching environment or intended professional use.

15. Professional Multipacks and Resale

Professional multipacks may be offered at discounted prices for use with clients or resale within an independent professional business.

Professional customers may choose whether to:

  • retain the benefit of the multipack discount as a resale margin; or

  • share some or all of the discount with their clients.

This is subject to any specific conditions stated with a promotion or partnership arrangement.

A professional customer reselling Birth Bumps products:

  • acts as an independent business;

  • is responsible for setting their own resale prices;

  • must describe the products accurately;

  • must not alter, repackage or relabel the products without written permission;

  • must not represent themselves as an employee, agent, franchisee or authorised representative of Birth Bumps;

  • is responsible for their own sales, customer service, delivery, returns and refunds; and

  • must comply with applicable consumer, tax and business laws.

Any recommended retail price communicated by Birth Bumps is a recommendation only. Professional customers remain free to determine their own resale prices.

Purchasing products does not provide territorial exclusivity or an exclusive right to represent, distribute or sell Birth Bumps products.

Larger-volume wholesale, distribution and retail arrangements may be subject to separate written terms.

16. Standard Professional-Use Licence

A professional customer who purchases a genuine Birth Bumps Card Game may use that physical product in their own work with individuals, couples or groups.

This permission is a limited, continuing, non-exclusive and non-transferable licence to use the purchased product for its intended professional purpose.

The standard professional-use licence:

  • covers one individual professional or facilitator;

  • permits repeated use of the purchased physical product within that facilitator’s own classes or professional services;

  • does not transfer ownership of any Birth Bumps intellectual property;

  • does not automatically cover colleagues, employees, subcontractors or other facilitators; and

  • continues while the licensed professional owns the legitimate purchased product and complies with these Terms.

If an organisation purchases a product for professional use, the standard licence covers one facilitator nominated by that organisation. Additional facilitators require written agreement with Birth Bumps.

Products purchased for resale do not give the reseller or their staff a professional-use licence unless a product is separately allocated and licensed for that purpose.

17. Class Pack Licence

Where a product is expressly sold as a Birth Bumps Class Pack, its purchase includes a limited licence for one professional facilitator to use the supplied materials in their own classes or courses.

The licensed facilitator may:

  • display and use the supplied posters;

  • facilitate the activities described in the Class Booklet;

  • use the supplied Card Games with participants;

  • discuss and explore the activities within paid or unpaid classes; and

  • repeat the supplied activities across their own classes.

The Class Pack licence permits facilitation of the activities. It does not permit reproduction of the materials.

Unless Birth Bumps agrees otherwise in writing, the facilitator must not:

  • photocopy or reproduce cards, posters or booklets;

  • scan, photograph or distribute the materials digitally;

  • provide participants with copied or recreated versions;

  • remove individual resources and resell them separately;

  • adapt the materials into their own branded course products;

  • use the materials to train or license other facilitators;

  • upload the materials to an online course or resource library;

  • share the Class Pack across a franchise, educator network or multiple sites; or

  • represent the activities or materials as their own intellectual property.

The Class Pack licence is non-exclusive and non-transferable. It continues while the licensed facilitator owns the genuine Class Pack and complies with these Terms.

18. Multiple Facilitators and Organisations

The standard professional and Class Pack licences cover one facilitator.

Use by any of the following requires prior written agreement with Birth Bumps:

  • more than one facilitator;

  • a training school;

  • a franchise;

  • a multi-site organisation;

  • an educator network;

  • an organisation lending materials between facilitators; or

  • a business using the materials to train other professionals.

Birth Bumps welcomes enquiries about wider licences and partnerships. Terms and pricing may reflect the number of facilitators, sites and intended uses.

No wider licence arises merely because an organisation purchased, reimbursed or owns the physical product.

19. Professional Licence Restrictions

Unless expressly permitted by these Terms or agreed in writing, Birth Bumps products, cards, artwork, text, activities and resources must not be:

  • copied or reproduced;

  • scanned, photographed or recorded for redistribution;

  • uploaded or shared as separate digital resources;

  • adapted to create another commercial product;

  • sold or distributed separately from their original product;

  • used to create training materials for third parties;

  • used to create substantially similar cards, games or resources; or

  • represented as content created or owned by the professional customer.

Nothing in this section prevents discussion of the ideas and techniques within a genuine class or professional service conducted under the permitted licence.

20. Referring to Birth Bumps in Professional Marketing

A licensed professional may make accurate, factual statements about using Birth Bumps products, such as:

“This class uses Birth Bumps birth-preparation activities.”

This permission does not allow the professional to:

  • use the Birth Bumps logo without permission;

  • describe themselves as accredited, certified or approved by Birth Bumps;

  • imply that Birth Bumps endorses their wider services;

  • use branding in a way that may cause confusion about their relationship with Birth Bumps; or

  • register a business, domain, social-media account or advertising campaign using the Birth Bumps name.

Any statement about Birth Bumps must be accurate and consistent with the intended use of the product.

21. Product Images and Reseller Marketing Materials

Professional resellers may use official product photographs, descriptions and marketing materials only where Birth Bumps has specifically supplied or approved them for resale use.

Permission to use approved materials is:

  • non-exclusive;

  • limited to promoting genuine Birth Bumps products;

  • subject to any brand or usage guidance supplied; and

  • withdrawn when the reseller stops selling Birth Bumps products or materially breaches these Terms.

Purchasing products does not provide permission to copy every image, illustration, video, article or other item from the Birth Bumps website or social-media accounts.

Approved materials must not be altered in a misleading way or used to suggest an agency, franchise, endorsement or exclusive relationship.

22. Ending a Professional Licence

Birth Bumps may withdraw a professional-use licence if the licensee materially breaches the licence restrictions or infringes Birth Bumps intellectual property.

Where the breach can reasonably be corrected, we will normally provide written notice and a reasonable opportunity to correct it before withdrawing the licence.

Withdrawal of a licence does not affect rights or remedies arising from an earlier breach.

The licence will also end if:

  • the licensed product is sold, transferred or disposed of;

  • the licensee permanently ceases the relevant professional activity; or

  • the parties agree in writing that it will end.

23. Clinic Partners and Other Partnerships

Purchasing a product does not automatically create a Clinic Partnership, affiliate, commission, wholesale, distribution, franchise or agency relationship.

These arrangements require acceptance by Birth Bumps and may be governed by additional written terms covering:

  • eligibility;

  • product displays and promotional materials;

  • customer discount codes;

  • referral tracking;

  • commission or thank-you payments;

  • use of Birth Bumps branding;

  • data protection; and

  • ending the arrangement.

Participation in a partnership does not create an employment, agency, franchise or joint-venture relationship.

24. Intellectual Property

All intellectual-property rights in Birth Bumps products and materials—including the Birth Bumps name, logo, branding, card designs, illustrations, text, activities, photographs, videos, downloads and website content—belong to Birth Bumps or its licensors.

Purchasing a product gives you ownership of the physical copy supplied. It does not transfer ownership of the intellectual property contained within it.

Consumers may use a product for its intended personal purpose. Professional customers may use it only as permitted by the professional licence provisions in these Terms.

You may not copy, reproduce, publish, distribute, modify, license or commercially exploit Birth Bumps intellectual property without permission.

Nothing in these Terms prevents any use permitted by law that cannot legally be restricted.

25. Shopify and Third-Party Services

Our online store is hosted and supported by Shopify.

When you purchase a Birth Bumps product, your contract of sale is with Jenny Parsons trading as Birth Bumps, not Shopify.

Shopify, payment providers, delivery providers and other service providers may process information needed to operate the store and complete your transaction. This is explained in our Privacy and Cookie Policy.

The website may provide access to tools or services operated by third parties. Their own terms and privacy information may apply.

Nothing in this section removes Birth Bumps’ responsibility for fulfilling an accepted order or any rights you have against us under applicable law.

26. Third-Party Links

Our website may contain links to websites operated by other organisations.

These links may be provided for information or convenience and do not necessarily mean that Birth Bumps endorses every statement, product or service on the linked website.

We are not responsible for the content or availability of independent websites we do not control. Please review their terms and privacy information before purchasing from or providing information to them.

27. Reviews, Feedback and Submitted Content

If you submit a product review or other content for publication, you give Birth Bumps permission to display, reproduce and use that content in connection with our website, products and marketing.

This permission is non-exclusive, worldwide and royalty-free. It continues while the content is reasonably used or until we agree to remove it, subject to legal and record-keeping obligations.

You confirm that:

  • the content is your own or you have permission to submit it;

  • it is honest and not deliberately misleading;

  • you disclose any payment, free product or incentive received;

  • it does not infringe another person’s rights; and

  • it is not unlawful, abusive, discriminatory or defamatory.

We may moderate or remove content that we reasonably believe breaches these requirements.

We will not use an identifiable customer photograph for wider promotional purposes without appropriate permission.

28. Website Errors and Availability

We take reasonable care to keep website information accurate and current.

Occasionally, the website may contain an error concerning a product description, price, promotion, availability, delivery charge or estimate. We may correct an error when it is identified.

If an error materially affects an order you have placed, we will contact you and explain the available options. We will not replace an agreed price or product with a materially different one without your agreement.

We do not guarantee that the website will always be available without interruption. We may temporarily suspend access for maintenance, security or circumstances outside our reasonable control.

Website interruption does not remove our obligations relating to an order already accepted.

29. Personal Information and Cookies

We use personal information and cookies in accordance with our Privacy and Cookie Policy.

That policy explains:

  • what information we collect;

  • why and how we use it;

  • the service providers involved;

  • how long information is retained;

  • international transfers;

  • individual rights;

  • advertising and analytics cookies; and

  • how cookie choices can be managed.

30. Our Responsibility to Consumers

We are responsible for losses a consumer suffers where those losses are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

Loss is foreseeable if it was obvious that it might happen or if both you and Birth Bumps knew it might happen when the contract was formed.

We are not responsible for losses arising from:

  • use of a product contrary to its instructions or intended purpose;

  • failure to seek appropriate medical or professional advice;

  • circumstances outside our reasonable knowledge or control; or

  • business use of a product purchased as a consumer.

We do not exclude or limit responsibility where doing so would be unlawful. This includes responsibility for:

  • death or personal injury caused by our negligence;

  • fraud or fraudulent misrepresentation;

  • breach of statutory rights relating to our products; or

  • any other liability that cannot legally be excluded or restricted.

31. Responsibility for Professional Use

Professional customers are responsible for:

  • deciding whether a product is appropriate for their clients, services and teaching environment;

  • exercising their own professional judgement;

  • the content and delivery of their wider services;

  • maintaining suitable qualifications, permissions and insurance;

  • complying with relevant professional standards; and

  • making clear that Birth Bumps does not provide accreditation or endorsement of their services.

Birth Bumps is not responsible for a professional customer’s:

  • independent teaching, advice or services;

  • alteration or unauthorised presentation of the materials;

  • acts or omissions when working with clients;

  • failure to comply with professional requirements; or

  • business decisions or anticipated profits.

We do not exclude or limit liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any liability that cannot legally be excluded.

Subject to those exceptions, neither party will be liable to the other for indirect or consequential loss, loss of profit, loss of revenue, loss of anticipated savings or loss of business opportunity arising from a professional order.

Nothing in this section removes our responsibility to supply products that conform to the contract.

32. Events Outside Our Reasonable Control

We are not responsible for delay or failure caused by circumstances outside our reasonable control.

These may include severe weather, transport disruption, postal delays, industrial action, interruptions to utilities or communications, natural disasters, epidemics, government action or failures affecting suppliers.

We will take reasonable steps to minimise the effect of the disruption and contact affected customers where appropriate.

This section does not remove any cancellation, refund or other rights consumers have under applicable law.

33. Complaints

If you have a concern about an order, product, professional licence or use of the website, please contact info@birthbumps.com so that we have an opportunity to resolve it.

We aim to acknowledge complaints promptly and provide a full response as soon as reasonably possible.

Nothing in this section prevents a consumer from exercising their legal rights or seeking another available remedy.

34. Changes to These Terms

We may update these Terms to reflect changes to our products, website, professional offering, business practices or legal obligations.

The Terms applying to a purchase will normally be those made available when the order was placed. A later change will not retrospectively alter an accepted order or existing professional licence unless:

  • the change is required by law;

  • it does not materially disadvantage the customer or licensee; or

  • the affected parties agree to it.

The date at the beginning of this page shows when the Terms were last updated.

35. General Legal Provisions

Each section of these Terms operates separately. If a court or relevant authority decides that part of a section is unlawful or unenforceable, the remaining provisions will continue to apply.

If we do not immediately enforce a right under these Terms, this does not mean that we have waived that right.

These Terms are between you and Birth Bumps. Unless the law provides otherwise, no other person has a right to enforce them.

Headings are included to make the Terms easier to navigate and do not affect their interpretation.

36. Governing Law and Courts

Consumers

These Terms are governed by English law.

If you live in England or Wales, you may bring legal proceedings in the courts of England and Wales.

If you live in Scotland, you may bring proceedings in either the Scottish courts or the courts of England and Wales.

If you live in Northern Ireland, you may bring proceedings in either the Northern Irish courts or the courts of England and Wales.

Nothing in this section removes any mandatory protection available under the law of the country in which you live.

Professional customers

For professional and business purchases, these Terms and any dispute or claim arising from them are governed by English law.

The courts of England and Wales will have exclusive jurisdiction over disputes relating to professional and business purchases unless we agree otherwise in writing.
